Terms of Trade
The minimum order customers may make is: 100 € (EUROS) net.
We only deliver internationally after prepayment has been made.
The full invoice total has to be paid into our account, no later than 14 days after the issue date.
The invoice total can be discounted by 2%, for prompt payment, if settled within 7 days of the invoice date.
If the invoiced amount remains unpaid, for more than 14 days after issue, we reserve the right to charge another 10%, of the invoice total, for additional handling.
Deliveries are made as soon as possible or as arranged with the customers. We reserve the right to deliver part shipments.
An item that is out of stock at the time of ordering will only be delivered later at the express wish of the customer.
Delivery can be made, either by regular post or UPS. Shipping and packaging costs will be added to the customer's final invoice, accordingly.
All risk during transport is that of the purchaser.
At the request of the customer we can provide transport insurance, at their own expense.
Please check legal rights and import provisions of your state or country before you place your order. We don't assume any liability for from the custom confiscated goods.
Any damages incurred during transit are the responsibility of the haulage provider and any claims for lost or damaged goods must be made to them and are dealt, with according to their terms and conditions.
Complaints about damaged items and all other complaints are only valid when they reach us in writing within 24 hours of your order being received. Defective items must be sent back to us by the customer when we request it; we will pay the return shipping cost. Returned items must be send back on the most economical way.
If customers return items without our consent, they pay for shipping and packing.
Customers have to examine the delivered items for damage immediately; our warranty covers justifiable damage. In warranty cases we will either repair or replace the item in question.
Until payment is received in full, the items remain property of Near Dark GmbH. For account customers, a payment will be considered late if it remains unpaid after 14 days of the invoice being issued. Any discounts become invalid immediately and are added to the bill and standard bank interest will be applied to the new total and added daily. We allow a 2% discount if payment is made by COD or pre payment.
As most of the articles are handcrafted, there may be slight variations from the features described in the catalogue. All size and colour specifications given are approximations. Please note that we are unable to exchange or make refunds on items that have been used.
