Shipping to Other Countries

For all countries not listed, shipping is available only after individual review. We will be happy to provide the shipping costs upon request.

Notes

·         All prices are net and subject to the applicable statutory VAT.

·         Free shipping applies once the stated net order value has been reached.

·         Dangerous goods surcharges are charged once per order in addition to the applicable shipping costs.

·         Different shipping conditions may apply to islands, overseas territories and special regions.

·         Dangerous goods are subject to special shipping regulations depending on the destination country. If shipment by parcel service is not possible, delivery will be arranged individually by freight forwarder.

Delivery, Payment and Claims Terms

Transport Damage

Visible transport damage should, where possible, be reported directly to the carrier upon delivery and then communicated to us without delay.

Goods Receipt and Claims

The delivered goods must be inspected immediately upon receipt. For business customers, the inspection and notification obligations pursuant to Section 377 of the German Commercial Code (HGB) apply.

Complaints must be submitted to us in writing after the defect has been identified. Defective goods must be returned to us with sufficient postage after prior consultation.

For justified claims, we will reimburse reasonable return shipping costs or credit them by agreement.

If goods are returned without our prior approval, any resulting transport and packaging costs may be charged to the customer. Unless otherwise agreed, we may choose between repair and replacement delivery.

Warranty

For justified defects, we provide warranty coverage in accordance with statutory provisions. Where legally permissible, warranty service is provided at our discretion by repair or replacement delivery.

Retention of Title

The goods remain the property of NEAR DARK GmbH until payment has been made in full.

Prices

All prices are net ex warehouse plus the applicable statutory VAT.

Payment Terms

Delivery is generally made against advance payment or via the payment methods offered.

Delivery on account or payment by direct debit is available only by prior agreement.

After expiry of your individual payment term, payment default occurs in accordance with statutory provisions. In the event of default, we charge the statutory default interest.

Product Information

As many of our items are handmade, they may vary slightly from the characteristics shown in the catalogue or online shop.

All dimensions are approximate.

Used goods are generally excluded from exchange unless statutory warranty rights apply.

Final Provisions

Errors, printing mistakes and price changes are reserved.

Upon publication of a new price list, all previous price lists become invalid.

The place of jurisdiction, to the extent legally permissible, is Siegburg, Germany.
